Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Dentara.ai website and the Dentara AI Voice Agent platform (the "Service") operated by Dentara ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. B2B Service Provision
Dentara provides an artificial intelligence software platform designed for dental practices to automate patient communications. The Service is strictly a Business-to-Business (B2B) application. By subscribing to Dentara, you represent that you are an authorized representative of a registered dental practice or DSO.
2. Client Obligations & TCPA Compliance
As the user of the Service, you are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA) and all other local, state, and federal laws regarding telecommunications, SMS marketing, and automated voice calls. Dentara provides the technical infrastructure, but you are solely responsible for ensuring you have obtained explicit, legally valid consent from your patients to contact them via automated systems.
3. Limitation of Liability
DENTARA IS NOT A MEDICAL PROVIDER. The AI agents provided by our Service are software tools and are not capable of providing medical advice, diagnosis, or emergency triage. We are explicitly not liable for any medical malpractice, adverse patient outcomes, miscommunications, missed bookings, or lost revenue resulting from the use of our AI software.
In no event shall Dentara, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
4. Payment & Subscriptions
The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (monthly or annually). Setup fees cover the engineering and provisioning of custom AI infrastructure and are due immediately upon sign-up.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Dentara and its licensors. You may not use our trademarks, trade dress, or AI prompts without prior written consent.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
